This Privacy Policy is a Legal Agreement

This Privacy Policy (“Policy”) is a legal agreement between you and New America, LLC., the owner and provider of the NewAmerica.social website. NewAmerica.social is a trade name for New America, LLC. This Policy is governed by and part of a Service Agreement. Please read this Policy and the Service Agreement carefully before registering as a Member of the NewAmerica.social. By accessing the NewAmerica.social website you are agreeing to the terms and conditions of this Policy and the Service Agreement. The NewAmerica.social Network

This NewAmerica.social website is part of a network of affiliated dating and networking websites (“Affiliates”) that cater to professional, successful, and serious gay singles. (the “NewAmerica.social Network”). All of the websites within the NewAmerica.social Network are owned or operated by Family United LLC.

We will create and maintain your profile in the NewAmerica.social database. NewAmerica.social, will not share your profile or username with other NewAmerica.social Members, except with the Members you are introduced to. You are agreeing that your profile may be displayed to such Members. Only those Members of NewAmerica.social can view your profile unless you set your profile to invisible or restrict access to portions of your profile.



Affiliate Websites

Affiliate websites are landing pages which provide a portal to the NewAmerica.social website, which potentially increases the number of Members with whom you may have a match. Affiliate websites within the NewAmerica.social Network have different domain names, but all link to the NewAmerica.social website. No one who is a NewAmerica.social Member, and who accesses the NewAmerica.social website through an Affiliate landing page, can view your profile on the NewAmerica.social website, unless it is a Member to whom you are introduced to.



Your Personal Information

NewAmerica.social is committed to ensuring that your “Personal Information” (defined below) is protected, but you must also take necessary steps to protect your Personal Information from access by persons whom you do not wish to view it, including anyone who is a NewAmerica.social Member. This Policy was created to demonstrate NewAmerica.social’s commitment to protecting your Personal Information and to inform you how NewAmerica.social handles information it receives from you. This Policy only applies to transactions and activities in which you engage and data which is gathered on the NewAmerica.social website, but does not apply to any non-Affiliate websites or offline point of contact or any other company or consumers with whom you may interact and which NewAmerica.social does not control.



Entering into This Legal Agreement

By accessing the NewAmerica.social website, you agree to be bound by the terms and conditions of the Service Agreement and this Policy, for as long as you are a Member of NewAmerica.social and/or use the NewAmerica.social website. If you do not agree to the terms and conditions of this Policy, please do not enter the site or do not register as a NewAmerica.social Member. If at any point as a NewAmerica.social Member you disagree with any of the terms and conditions contained in this Policy or those in the Service Agreement, you may terminate your membership by sending an email to support@NewAmerica.social.



Your IP Address

Each time you visit the site, NewAmerica.social automatically collects your IP address, NewAmerica.social Cookie information and the web page from which you entered the site. NewAmerica.social uses that information and your IP address to identify you and to gather demographic information about you to diagnose problems with NewAmerica.social’s site and to administer and optimize the NewAmerica.social website for your use.



Cookies

NewAmerica.social uses cookie files saved to your computer for record keeping purposes. NewAmerica.social can also use cookies to deliver content specific to your interests, to save your password, and if you choose, to save other Personal Information, so you do not have to re-enter it each time you visit the site. To disable these cookies, simply go to the “help” portion of the toolbar on your browser, which should tell you how to proceed. However, if you set your browser to disable cookies, you may not be able to access certain areas on the NewAmerica.social website.



Your Personal and Financial Information

Personal information is personally identifiable information like your name, address, email address, or phone number that is not otherwise publicly available (“Personal Information”). NewAmerica.social collects Personal Information from you to better serve your needs. NewAmerica.social does this in order to operate the NewAmerica.social website and occasionally to display advertisements about products or services that may be of interest to you. We also collect financial information such as your credit card numbers, PayPal information, passwords, and in connection with some of our websites and applications, certain income information (“Financial Information”). Further, NewAmerica.social collects certain demographic information that is neither Personal Information nor Financial Information, which may include, but is not limited to, zip code and username. If your membership is terminated, NewAmerica.social will maintain your profile and your Personal and Financial Information in its database for up to two years and may maintain your blog and forum posts for more than two years. So long as your information is in the NewAmerica.social database, the terms of this Privacy Policy and the Service Agreement will apply to your information whether your membership is active or is not. Following two years after your membership is terminated, NewAmerica.social reserves the right, but does not have the obligation to eliminate your information from its database.

NewAmerica.social does NOT knowingly collect Personal Information from children under the age of 18. NewAmerica.social requires that all Members affirm that they are at least 18 years old.



Information from Other Sources

NewAmerica.social may obtain Personal Information and non-personal information about you from the NewAmerica.social Network and credit card or other payment processors, which NewAmerica.social adds to its account information or other information it has collected for management purposes. This information includes user preferences, email addresses, user site preferences, and billing information.



Information About You and Others

NewAmerica.social may collect and store Personal Information that you provide to us about other people, such as their name, address and email address. This information will be used solely for the purpose for which it is provided, such as your referral of our service to others, or to manage your product purchase information. If you use the NewAmerica.social website to send a product or a gift to others (friends, relatives, colleagues, etc.), NewAmerica.social may store your Personal Information, including your product purchase history, product preferences, and product recipient information, in order to process those requests and facilitate your future purchase activities.



Other Websites

You need to be aware that when you visit Affiliate websites, (regardless of whether or not they contain the NewAmerica.social brand names, trademarks and other intellectual property), they are merely landing pages which provide a portal to the NewAmerica.social website. Websites other than Affiliates should have their own privacy policy if they are collecting Personal Information about you. NewAmerica.social encourages you to review non-Affiliate websites’ privacy policies and reminds you that NewAmerica.social is not responsible for non-Affiliate websites’ actions or the actions of others to whom you provide your username, profile, or other Personal Information.



How NewAmerica.social Uses Personal Information

NewAmerica.social uses your email address and your other Personal Information to operate the NewAmerica.social website efficiently, to contact you in connection with your membership and other activities on the website (including, but not limited to, confirmation emails or important news that could affect your relationship with NewAmerica.social or NewAmerica.social), and to forward messages to you from other NewAmerica.social Members. These types of communications are known as “Operational Communications.”

To operate the NewAmerica.social website, NewAmerica.social may share your Personal Information with NewAmerica.social’s agents, representatives, contractors and service providers so they can provide NewAmerica.social with support services such as authorization of credit card transactions, email origination, receipt or support services, and customer relationship management services. NewAmerica.social requires these entities not to use your Personal Information for any other purpose.

Any Third Party (not NewAmerica.social) with whom you permit NewAmerica.social to share your Personal Information is authorized to use your Personal Information in accordance with our contractual arrangements with such Third Parties and in accordance with their own privacy policies, over which NewAmerica.social has no control. You agree that NewAmerica.social is not responsible or liable for any Third Party actions or omissions. You will need to instruct any Third Parties who contact you regarding your preferences for their use of your Personal Information.

You agree that your Personal Information and Financial Information may be provided to a Third Party in the event of a transfer of ownership or assets by NewAmerica.social or a bankruptcy or to comply with the law or to protect the interests or safety of NewAmerica.social or other visitors to the NewAmerica.social website.



How NewAmerica.social Uses Financial Information

If applicable, NewAmerica.social may use your Financial Information to check your qualifications and to bill you for services. By making a purchase, or engaging in any other kind of activity or transaction that uses Financial Information on the NewAmerica.social website, you consent to our providing your Financial Information to NewAmerica.social’s service providers and to such Third Parties as NewAmerica.social determines are necessary to support and process your activities and transactions, as well as to your credit card issuer. These Third Parties may include the credit card companies and banking institutions used to process and support the transaction or activity.



Location Information and Services

The NewAmerica.social website includes location based services and features. These features are used to connect you to other users based upon your geographic location and to provide other services that personalize your experience. To implement these features, NewAmerica.social collects your location data, including but not limited to GPS data, Wi-Fi data, and cell tower data.



How NewAmerica.social Uses Public Information and Other Demographic Information

NewAmerica.social may review all your demographic information. NewAmerica.social may use public information to determine whether you are a match to other NewAmerica.social Members and to communicate with you. NewAmerica.social may use demographic information to tailor the NewAmerica.social website and cater to your interests.

NewAmerica.social may also use the information you provided during registration to automatically set up an email account for you at the registered site, to make online dating and social networking more convenient and secure.

NewAmerica.social’s Security Precautions

The NewAmerica.social website and mobile application have security measures in place to protect against the loss, misuse and alteration of the information under NewAmerica.social’s control. NewAmerica.social encrypts all of your Personal Information and Financial Information as it travels over the Internet and NewAmerica.social stores your Financial Information on its servers in encrypted form. However, although we strive to maintain necessary safeguards to protect your Personal Information, Financial Information and other data, you acknowledge and agree that we cannot ensure the absolute security or privacy of such information in the case of an unauthorized breach of those safeguards by a third party. Your Personal Information and Financial Information and other data may be transferred to and maintained on computer networks which may be located outside of the state, province, country or other governmental jurisdiction in which you reside, and the country or jurisdiction in which these computer networks are located may not have laws which are as protective of your privacy as the laws in your country or jurisdiction.

NewAmerica.social can process your payments through PayPal, which will allow you to securely process your transactions, without you having to share your Financial Information with NewAmerica.social. NewAmerica.social uses both in-house and third party security measures to attempt to detect Members using NewAmerica.social in violation of the Service Agreement and/or this Privacy Policy. NewAmerica.social reserves the right to terminate such Members.



How You Can Access and Update Your Email Preferences, Personal Information and Public Information

At any time, you may modify Personal Information or demographic information you have provided to NewAmerica.social. Please be aware that it may take several hours for the changes you make to take effect on the public areas of the NewAmerica.social website and the NewAmerica.social database. Thank you for your patience. Please note that changing or deleting your information will only change or delete the data in the NewAmerica.social database for purposes of future activities on the NewAmerica.social website and for managing future communications from NewAmerica.social. These changes and deletions will not change or delete emails or information that NewAmerica.social may have already forwarded to other users or credit card companies or any other Third Parties, all as provided above in this Privacy Policy. Further, if you delete your information from the NewAmerica.social website, but place future orders with NewAmerica.social, you may receive emails from NewAmerica.social regarding those orders.

NewAmerica.social applies attributes used to classify user profiles, including items such as age, gender, location, STD type(s), and source or name of Affiliate website. By registering with the NewAmerica.social website, you acknowledge and agree that NewAmerica.social may apply such classifications to your profile and may use such classifications to restrict:

the availability of communication between you and other Members of NewAmerica.social;
the availability of the details of other Members that you can see; and
the availability of your details that other Members can see.
Terms of Privacy Policy Subject to Change

IF AT ANY POINT NewAmerica.social DECIDES TO USE PERSONAL INFORMATION IN A MANNER DIFFERENT FROM THAT STATED AT THE TIME NewAmerica.social COLLECTED IT, NewAmerica.social WILL NOTIFY MEMBERS BY AN EMAIL OR NOTICE ON THE NewAmerica.social WEBSITE PROVIDING 30 DAYS’ NOTICE AND AN OPPORTUNITY TO ACCEPT OR NOT TO ACCEPT ANY MATERIAL CHANGES IN THE POLICY. WITH REGARD TO INFORMATION GATHERED OR AFTER YOU ACCEPT THE CHANGES IN THE POLICY, NewAmerica.social WILL HAVE THE RIGHT TO USE YOUR PERSONAL INFORMATION WITHOUT FURTHER NOTICE. IF YOU DO NOT ACCEPT THE CHANGES OR DISAGREE WITH THEM, YOU MAY TERMINATE YOUR MEMBERSHIP BY SENDING AN EMAIL TO SUPPORT@NewAmerica.social AT ANY TIME.

IN ITS SOLE DISCRETION, NewAmerica.social RESERVES THE RIGHT AT ANY TIME TO MODIFY, CHANGE, ADD OR REMOVE ANY PORTION OF THE TERMS AND CONDITIONS OF THE PRIVACY POLICY AND THE SERVICE AGREEMENT, IN WHOLE OR IN PART. NewAmerica.social WILL PROVIDE YOU WITH WRITTEN NOTICE OF MATERIAL CHANGES TO THIS PRIVACY POLICY AND/OR THE SERVICE AGREEMENT AND WILL GIVE YOU THE OPPORTUNITY TO ACCEPT OR NOT ACCEPT SUCH CHANGES. IF YOU DO NOT ACCEPT SUCH CHANGES, YOU WILL NO LONGER BE GIVEN ACCESS TO THE NewAmerica.social WEBSITE AND YOUR MEMBERSHIP WILL BE TERMINATED.
